Thanks for the correction. I was trying to listen carefully, but I couldn't quite get that part.
They DID say that they're going to argue that Westerfield can't be executed, blahblahblah. I thought the reason was this "new evidence" (which is comical when you continue how long and drawn-out the investigation and trial were).
I heard the quote from the judge, that "his hands were tied" if the defense isn't ready.

The judge was IRKED after being forced to grant a delay. The defense wanted even more time--one of them said they'd be gone the last week of December--but the judge said, in essence, NO WAY. He started to develop this irritated note in his voice when he found out that the defense hadn't filed the proper paperwork and sounded like he wasn't going to put up with anymore defense BS, er, delaying tactics.
