They need to redo the circuits, the ninth has far far too much of a population. I guess it made sense when they were first formed.

The subject of Pickering and Owens was brought up at the President's press conference last week. He told reporters he doesn't have to "re-nominate" them, because they were never voted on by the Senate; they're still active at the committee level.

There seems to be some confusion here "Advise and Consent of the SENATE" does not mean an individual Senator should be able to thwart the President. Another tradition which just bit the dust was the one wherein one Senator does not lie to another and refuse to honor his promise, Senator Leahy. So if one tradition can go to the benefit of the RATS another can go for the GOP.

I find it amazing the Dems are in such a panic and are effectively threatening to spend the next to years in filibuster. The GOP spent nearly 40 years out of the majority we didn't talk about this kind of crap. I'd almost like the Dems to do what they're threatening, that would be the final nail in their coffin. Nothing would better demonstrate the corruption of the party than to have a Supreme Court seat empty for two years, that's political fodder we can use to get super majorities.

I guess 9th Circuit Judges will just have to come out of Utah and not California

Looks like it will have to be Nevada or Idaho. Which is even better than Utah, even if Utah were in 9th circuit instead of the 10th.

That map looks kind of out of whack. Maybe the circuits need rebalancing. The 9th would seem to be too big, while the 1st and maybe 2nd look too small, based on populuation. Congress has the power to change the circuit assignments, create new circuits or abolish the whole edifice if they want. (Art III, section 1 US Constitution)
