Just Say No To Justice Kathryn Werdegar

Date: Wednesday, October 16 @ 13:47:28 EDT

October 14, 2002

Anaheim, California — Officials from Traditional Values Coalition today urged California families not to support California Supreme Court Justice Kathryn Werdegar in her re-confirmation bid this November and have announced their plans to lead a statewide effort exposing her record on the bench.  Citing recent rulings, Rev. Louis P. Sheldon, Traditional Values Coalition Chairman, warned pro-family voters to examine her record carefully before casting their ballots.

“Justice Werdegar has displayed outrageous contempt for those values that California families hold dear,” said Sheldon. “In opinion after opinion she has opposed basic parental rights, religious liberties and property rights.  To be blunt, her rulings have been disastrous.”

In American Academy of Pediatrics v. Lungren, Werdegar agreed with the majority of the State Supreme Court and overturned state law requiring parental consent before an abortion could be performed on their minor child.

In Smith v. FEHC, Werdegar wrote that majority opinion for the court which found that a Chico woman did not have the 1st Amendment right to refuse to rent an apartment to an unmarried couple because of her religious beliefs.

In Ehrlich v. Culver, Werdegar agreed with the Court which found that a city could extort thousands of dollars from a property owner to pay for “loss of benefits to community” when the property owner applied for a zone change to convert a failed private tennis court to residential housing.

“Judicial races often do not receive wide media attention, but we hope to change that as the court system has a tremendous impact on our daily lives,” said Benjamin Lopez, Traditional Values Coalition Legislative Analyst.  “Justice Werdegar has proven to be a judicial activist unrestrained by either the Constitution or basic founding principles of our Republic.  Voters should take her gavel away on November 5th.  Enough is enough.”

No on Werdegar.
No on Baxter.
No on Moreno.

My reasons in reverse order.

Moreno voted in the Supreme Court decision that "Alameda County has the authority to prohibit the operation of gun shows held on its property"
Baxter agreed that the state of California can ban Assault Weapons.
Werdegar agreed with Baxter.

This single issue voter thinks TRUST is the issue.

How can you TRUST government that DO NOT TRUST you with guns?

Thanks for the link. Moreno is very liberal. Werdegar is liberal, too. Baxter is conservative on other issues like property rights, religious liberties, and parental notification for children seeking abortions.

The problem is that we want the replacements/successors to protect our rights more that the justices whose reconfirmations we reject. I have faith that Simon will win, but if Simon appoints conservative judges, will the CA Attorney General, CA Supreme Court Chief Justice Ronald M. George, and the Court of Appeals senior presiding justice approve them, or will they reject or stall like our US Senate has stalled President Bush's judicial appointments? If Simon loses, then Davis surely will appoint someone very liberal.

Baxter isn't perfect, but what is the likelihood that we will get someone better? Remember, Chief Justice George voted with the majority (Brown, Baxter, Werdegar, Chin, Mosk) for the ban on assault weapons in the article you cited, and CA Attorney General Lockyer (should he win reelection against Ackerman, who is close in the polls), is very liberal, including being very strongly opposed to the 2nd Amendment.

From the California announcements page, posted 10/21/2002 11:41 AM PDT, mvpel also said:
"All three of the justices up for confirmation are considered anti-gun by a local experience firearms rights attorney."
