While discussing the duel proposed by Iraq between Bush and Saddam, host Kuby stated "Mayebe we will get lucky and get rid of 2 threats to world peace"

I think you know exactly what I'm saying, but are just looking for an argument. I suspect that Mason and the other Framers would have scratched their heads over virtual child porn because it simply did not exist at the time the First Amendment was enacted. I also suspect that if they could appreciate the concept of virtual child porn, they would have correctly found that it is not protected speech under the First Amendment. But they may have also frowned upon the virtual child porn law that SCOTUS properly struck down last term, not because the First Amendment protects virtual child porn, but because the statute was so overbroad that it would have resulted in the uncontitutional suppression of protected speech.

#L ?'s actually a third problem with your Daschle analogy, in that Kuby's comments were made over the public airwaves, where additional First Amendment restrictions apply.

So because some nutjob out there would take this joke as a command to kill the President, this guy should be arrested? I don't think so, unless you want to establish a police state. There are nutjobs out there who get set off by really random things - e.g. movie violence. Should we ban violent movies? Get real. Nor is he yelling "Fire!" in a theater. He's not inciting any physical violence or disruption. He made a dumb joke, that's the bottom line, and the fact that you're taking it so seriously is the really amusing thing.
(You know, there's a joke that we should settle wars by having the leader of each country fight each other in a ring. Should anyone repeating this joke be arrested as a "terrorist" making threats against our Dear President?)

An even bigger shame is that Kuby's conservative counterpart is Curtis Sliwa, who probably does the show with that silly red beret of his.
Yeah, yeah, yeah. The red beret is a little over the top. But Sliwa is right on most of the issues.

It is illegal to make or promote threats to the president's life. The Secret Service could arrest this guy. But sadly, they probably won't.
