A U.S. bankruptcy official allegedly caught with his pants down in a Brooklyn courtroom has voluntarily resigned rather than go through with a public airing of his case, the Daily News has learned.
Lawyer Stuart Gelberg, a court trustee who supervised bankruptcy cases, will be allowed to complete his caseload, according to Jane Limprecht, a spokesman for the Justice Department's U.S. Trustee program.
Gelberg, 46, was caught in a compromising position with a woman in February, according to a formal complaint filed by lawyer Gus Farinella.
Farinella said he was "shocked and outraged" by the incident and called Gelberg's conduct in the vacant courtroom "disgusting and inappropriate."
He was scheduled to testify at a disciplinary hearing in August, but the hearing was abruptly canceled, according to Farinella's lawyer, Mel Sachs.
Limprecht declined to comment on Farinella's charges or whether they played a role in Gelberg's resignation from the post he has held since 1983.
Gelberg's salary of $148,368, which is higher than that of a federal judge, is based on the size of his caseload. Court officials said his pay will decline as his caseload does.
Gelberg did not return a call for comment. Previously, he told The News that Farinella was motivated by "personal animus" against him.
Farinella, a bankruptcy lawyer who had represented clients before Gelberg, denied that charge.
Sachs said Farinella was simply acting in keeping "with the highest ethical standards expected of a member of the bar."

sugests that Gelberg maxim sic utere tuo ut alienum non laedas. Therefore prima facie nullum crimen sine lege, nulla poena sine lege. Ipso facto the female is a amicus curiae and may have previous in camera actions.

Perhaps the problem is that the man was caught with a woman. This is too un-pc. If it was a man caught with a man then the bar would not have been upset. I probably would have praise the choice.
these circumstances are too full of personal animus. The lawyer who reported this, gus, really needs to have an investigation as to his reason for reporting this. This did not affect clients, court was not in session, while inappropriate to use an empty deserted room in a public building for entertaining, this lawyer must really be an a-hole to report such a trial act.
