It is hard to appear intelligent if the argument that "what they are doing is clearly illegal" is completely set aside.

We are taught to rely on the law, if you can't argue the law, you're left to look like a bumbling idiot.

Appellate argument is tough . . . but if you are getting hammered you need to call a spade a spade and get the most powerful arguments on the record. The crap about the N.Y. statute is completely disingenuous and he should tell the Chief Justice who handed the argument to the Democrats that it is. He should go down is a blaze of glory because the arguments won't make a difference.
