Not sure if he would get his name on the ballot or not, but I do know that he won't serve past Jan. when the new congress is sworn in.

As I understand it, that is what the Dems are going to court for...to avoid the 51 day law in NJ and get a new candidate's name on the ballot in place of Torch.

And that raises this question -- from where would the Governor get the authority to "appoint" a new candidate to replace Torch. Only if Torch resigns does the Gov. have any power to appoint someone. I guess it would be the state Democrat committee in NJ that selects the new candidate, not the Gov.
