I think that if they attempt to extend a Jersey term by intentionally vacating a seat and cancelling the election, that would be challenged to the US Supreme Court and disallowed.

The case would be a slam dunk too. Consider if the Supremes allowed it. In such a case, a state could enact a law just like New Jersey's. Then as long as that party kept control of the governorship, they would never have to put the seat up for election- each time the special election would be coming up, the "incumbent" could resign within 30 days of the electin, allowing the governor to cancel the election and appoint a new incumbent. When the next general election would come up, that new incumbent could resign, allowing the governor to cancel the election and appoint a new incumbent. And so on, as long as they maintained control of the governorship.

If the Dems try that gambit, I would bet a lot of money Scalia, Rhenquist, O'Connor, Thomas and Kennedy at a minimum would strike that law down.

We are outside of 30 days. Election day is Nov. 5th. They would have to wait another week (approx.) for the Torch to quit.

My question is: under the current system, wouldn't it be possible to have the same party in the Senate forever and ever. Once your party has the seat, all you have to do is have your candidate drop out of the race a week before election day and appoint another party guy to keep the seat. Of course, to do this, you'd have to have a cooperative governor that wouldn't order a special election.

I think the key will be the following language in the law enever a vacancy shall occur by reason of any cause other than the expiration of the term. It will be argued that the vacancy is due to the expiration of the term. Otherwise a senator could withdraw on the last day of election because the end of the term and be reappointed on the next day and serve for 8 years instead of 6. This interpretation won't fly. Its only valid when the upcoming general election is not already for the end of the term. The US senator terms are designed to rotate and this interpretation would contradict that.

Exactly my point. And it is because it would be an attempt to get beyond the constitutionally mandated 6 year terms, the SCOTUS would not hesitate to strike that down.

Torch had been using the "control of the Senate" argument. Freeing up resources for use elsewhere would be in line with that, and the Dems have to know it WOULD fire up the GOP's base so much that it could cancel out any GOTV efforts the Left has.
