Three Immigration and Naturalization Service deportation officers from San Antonio were arrested Tuesday morning in connection with the death of an illegal immigrant.
Carlos Reyna, 42, Richard Henry Gonzales, 36, and Louis Rey Gomez, 36, were each named in a five count indictment for allegedly violating the civil rights of an illegal immigrant.
The charges stem from an incident where the three INS officers arrested a number of illegal immigrants in Bryan on March 25, 2001.
According to the indictments, Reyna assaulted one of the immigrants, Serafin Olvera-Carrera, and caused him bodily injury that resulted in his paralysis from the neck down.
Olvera-Carrera died on Feb. 24, 2002, at St. Luke's Episcopal Hospital in Houston. An autopsy conducted by the Harris County Medical Examiner's Office concluded that the victim died as a result of complications caused by blunt force trauma to the neck.
Gonzales is accused of spraying Olvera-Carrera with pepper spray.
Reyna, Gonzales, and Gomez are also charged with deliberate indifference to the serious medical needs of Olvera-Carrera.
After appearing before a federal magistrate in San Antonio on Tuesday afternoon, the three men were released on bond.
If the suspects are convicted in a trial, they face a maximum penalty of 10 years in prison, without parole, and a $250,000 fine followed by at least three years of supervised release.

It's simple, really. If the ILLEGAL immigrant was not in the US, none of this would have happened. Let the INS guys go.

I hope you are being sarcastic. Certainly you're not saying it is permissible for gov't agents to murder illegal immigrants?

Illegals should have no civil rights, other then the right to be deported. They invaded this country and should be considered hostile.

What I am saying is, if you wake up in the morning and decide to illegally cross over an international border, you must assume the responsibility of your actions, however severe they may be. SCREW the ILLEGAL "immigrant"!!
Today, when I woke up, I decided NOT to purchase a plane ticket and NOT to go to some mideast RAT HOLE of a country where they hate Americans, sneak across a border illegally to a bigger RAT HOLE country and get my head stoved in. See how easy that was. I live another day.
Really quite a rational decision on my part.

We are a nation of laws. Are INS agents legally permitted to murder illegal immigrants? The INS officers have no RESPONISBILITY to kill illegal immigrants, assuming that they are not being threatened. Do they take an oath upon becoming INS officers? Does any part of that oath involve swearing to uphold the laws of the USA? Is there any law that says "Kill people who come into this country illegally?"

I sticking by what I wrote previously. Cause and effect. Action and reaction. The ULTIMATE RESPOSIBILITY of this outcome lies in the hands of the IDIOT who woke up that morning and decided to break the law and illegally enter the US. It's really simple, yes we are a nation of laws.....no I do not think the INS officers job is to kill illegal invaders. But having said that, I still say that had the trespasser chose to walk down to the corner go-go bar that day and suck down a few beers, he would have lived to see another day.
If you break the law, you suffer ANY AND ALL potential consequences. It's kinda like the science of physics, specifically dealing with "probable outcomes" . Each decision you make in each moment of each day has many "probable" outcomes as well as a few "improbable outcomes".
If you go skydiving or "extreme" skiing, you should have previously sat down and thought about the probable as well as POSSIBLE outcomes. If your parachute doesn't open, the probable outcome is that you will proceed to screw yourself into the center of the earth......it's a chance you take.
The illegal trespasser should have thought about the possibility of dying of dehydration, starvation, severe or deadly ass-kicking.....it all goes with the territory.
No, what happened shouldn't have happened, but it did. As far as I'm concerned the fault lies 100% with the a$$hole crossing the border that day, logically speaking it can not be any other way.
If you stand on the street corner and sell crack, you MUST take 100% responsibility for the consequences of your actions, no matter how severe they are. Once again, I agree with you that the INS has no responsibility to kill illegals........$hit happens, I would not fault the INS officer in this case.

...And Daschle says the President should NOT be able to fire them, RIGHT?

How does pepper spray relate to blunt force trauma? I'm confused here, did he beat him with the 64oz large economy size can?

There are some other things that are a bit disturbing about this picture as it is painted as well. Olvera lived in a house with many other illegal aliens....but it was his house. Smuggler? I know some people in the INS. They do not beat people because they are standing there. What was this guy doing that caused such a reaction? One guy is arrested because he supposedly beat the poor defenselss alien. Another sprayed him with mace. The third guy is looking at 10 years because he did not get him to a doctor. Was he a supervisor or in charge of the raid? I think there is more to this story than what we are hearing in our free yellow press. I guess I will have to await the next press release from Fox's office.

Who told you we were a nation of laws? The Government?
The same Government that says that the illegals do not have to follow the same laws that we do.
I have already asked President Bush to send me a list of the laws that I do not have to follow. Needless to say he has not answered my letter.
We are only a nation of laws for the suckers that have to follow them. You know the ones, the taxpayers.
You asked if there was a law stating that we should kill illegals. No but I bet if there was, the invasion would stop, don't you?

Is there any law that says "Kill people who come into this country illegally?" Perhaps there should be?
