An absolute disgrace in the murder trial of 7-year-old Danielle van Dam. That is the subject of this evening's Talking Points memo.

According to a report in The San Diego Union Tribune, convicted killer David Westerfield's attorneys, Steven Feldman and Robert Boyce, knew their client was guilty.

That's what I thought too... And I couldn't even get onto the website to see if he's had any disciplinary action taken against his license before because it keeps timing out...

Maybe everyone is filing their complaint like O'Reilly wants...

I'd hate to work for the CA state bar right now...

I used to work for the Chiropractic Board in AZ and dealt with many many complaints...

Our complaints and hearings were public unless the Board went into executive session... Not sure how it works for a professional association in relation to a professional license...

Thnx...I'm glad the investigation results can be made public. I just thought of something.. O'reilly said he got about 8000 emails about this subject. I wonder if the cal bar will get that many complaints.. YIKES!

I am not saying that Westerfield should get any less punishment if he had an accomplice, I am saying that the accomplice should not be allowed to go free to murder again. I think that if Dusek had further investigated the time line and bug evidence, it may have turned up an accomplice. I am saying that Feldman was pushing Dusek to work harder and that may not have been a bad thing.

Judge Napolitano told O'Reilly that anyone can file a complaint to the Calif bar

Hmm, if so I could easily see the "bar" getting bogged down to the point of inability to do anything else, with complaints when a popular enough cause is at stake. Sounds like a lousy law if so. You saying this is not your normal letter of complaint (just like I could complain to NBC about something on the news); you saying this is something which compels a court to take notice?

I'm sure that at this point Feldy is a member in good standing of the Calif. bar. Actually, notwithstanding Rule 2-500, & O'Reilly, & all the publicity, I expect he'll still be a member in good standing when the dust settles. Not that that's the way it should be, but because, as I said earlier, the ethical rules are violated/ignored more often than not by most criminal defense attorneys. I've never seen defense attorneys get disciplined for something like what has occurred here. They should be. But they aren't.

A child is kidnapped, missing with a country-wide hunt on for her yet one person knows where her BODY is dumped and and will point the police to the exact location in exchange for a lenient sentence. That's circumstancial evidence in your book?

No, it doesn't "compel a court to take notice." The courts have nothing to do with it. It is the state bar association who has to deal with complaints about lawyers. There's no reason why multiple complaints about a lawyer regarding a single case would "bog down' the system. Regardless of how many folks complain, the allegations have to be investigated.

I'm going to throw something in here that is a bit off topic, but yet relative.......I think.

First I need to go on record stating that 99.9% of the time I am ready to string up every defense attorney. I'm anything but a bleeding heart.

So.......I wonder how big a difference there is between a prosecutor and a defense attorney, ethically speaking. I ask because many, many former prosecutors become defense attorneys. It has always made me wonder.
