While I have not been bothered, under the law, I could be bothered for not harming anyone. If I'm smoking a joint while driving - lock me up. If I give your kid pot - lock me up. If I'm smoking MJ in the city park - lock me up.
However, why should it be illegal for me to do an activity, when it does not harm you and yours. The point here is that I can be arrested for not harming a single person. I find that to be immoral. Do you not agree?
