40 seats are not in play, not by a long shot. Very few seats will change hands this November. A President loses 40 seats only if he is extremely unpopular. Obviously Bush is not. Now whether the Dems can get lucky and pick up 7 or 8 is another thing...and that would be enough to narrowly take the House.

The problem is more complex than maybe you realize. Some of us realize today that the record breaking economy engineered by the previous administration
never existed. They created it on paper through fraud.
How many newspapers, radio stations, television stations are there across America? How many headlined this story? Was the percentage more than .0001?

It looks like the Dems are likely to take the house unless somthing happens between now and then ; like a war with Iraq. That doesn't look likely though. It looks like the admin is waiting until closer to the next presidencial election to pick up point on a war with Iraq. Bush will be a shoe in if we're at war or just finished off Sadam durring the election. They aren't going to waste that kink of political leverage on maintaining the house.
The financial scandals certainly hurt republicans more than democrates but unless a particulare candidate was directy involved I don't think that it will hurt more than a few points. That'll be Enouph for the dems to take the house.
The economy is going to hurt incumbents in general.

Dem's are not going to take the house. Republicans will retrieve the Senate until another RINO jumps ship.If the R's win a comfortable margin there will be no jumping. The only 2 who may are Chaffee and McCain and I think both prefer the majority party which ever it is next January. If the R's are up by at least 3 they won't jump.
