I seriously doubt it unless they become POW's. I think he wants a way to hold them for the safety of the country

That's where the trust comes in. I would argue that historical precedent warns against trusting a government with too much power. Maybe Ashcroft is benign, but if this kind of power is legally unchallenged, how can we be so sure is successor will use it justly. History, again, has shown us we cannot.
