Somewhere in all the news reports, it seems like I saw something about the local judge saying, he thought the perp was in some militia...If that is so, it is rather odd for the judge to be saying that without some knowledge or intent.
This was the judge he dealt with in 1998, when he filed documents with the court that any law enforcement officer that attempted to detain him did so at their own peril, citing a largish dose of pseudolegal rhetoric.
I can see how a judge might come to the conclusion that the guy was in the militia.
