Fox News interviewed Angela and Ricci's attorney this morning and I remarked to my husband that she looked infinitely "harder" and less "sweet" than she had in the Larry King interview. He remarked that Larry King had been "throwing snowballs" and Fox was "throwing fastballs"...She claimed no knowledge of Ricci's previous alleged burglary in a woman's home in the Smart neighborhood (the woman woke, didn't see anything, and only realized the next morning she'd been robbed when she found the door open and money missing)

She also insisted Ricci had indeed been in bed with her "all night" even though this assertion was immediately followed by the question "how could anyone know for certain, if they were asleep"? She just jutted her jaw and insisted. She held her head at an angle and glared at the camera out of the corner of her eye. For sure, under the glaring lights of the Fox studio, she looked more like the con we know she is, without Larry King's flattering lighting to make her look soft and vulnerable. Today, she looked defensive and hostile.

   Last year, in the middle of an April night,Richard Albert Ricci broke into a home in Elizabeth Smart's Federal Heights neighborhood and awakened a woman as he rummaged through a darkened bedroom, according to a burglary charge filed against Ricci on Thursday.
    The sleepy house guest thought the intruder was a family member and simply rolled over and went back to sleep.
    The next morning, homeowner Sue Ann Adams found a sliding glass door open and discovered jewelry and cash were missing.

    While acknowledging that Thursday's burglary charge had nothing to do with Elizabeth's June 5 disappearance, police say Ricci's alleged break-in shows he was brazen enough to enter a home where people are sleeping.
    "It shows a pattern of [Ricci's] conduct," said Salt Lake City Police Chief Rick Dinse, who has placed Ricci at the top of the list of potential suspects in the abduction of 14-year-old Elizabeth from her bedroom while her parents slept.
    Ricci also was charged Thursday with third-degree felony theft for allegedly pilfering $3,500 worth of jewelry, perfume and other items from the Smart home while he worked odd household jobs for the family in June 2001.
    In the Adams case, Ricci is charged with second-degree felony burglary and class A misdemeanor theft.
    Ricci, 48, has repeatedly declared his innocence in Elizabeth's abduction and faces no charges connected to the case. He "is not the sole focus of the investigation," Dinse said.
    Lacking sufficient evidence at this time tying Ricci to Elizabeth's disappearance, Dinse added: "If I could have charged him, I would have."
    Ricci's lawyer, David K. Smith, pointed out in a statement he read to reporters Thursday that "the charges are for conduct that occurred over one year ago and have nothing whatsoever to do with the disappearance of Elizabeth Smart.
    "That said, Mr. Ricci would like me to convey his sincere apologies to the Smart family, and like you, he prays for Elizabeth's safe return," the statement said. Smith later added that his client, who has taken two lie-detector tests, would be willing to submit to more to clear his name.
    "He has attempted to be as forthcoming as possible; he is willing to do anything" authorities ask, Smith said.
    Ricci admitted to the separate thefts when questioned by investigators last month, according to the charges filed in 3rd District Court.
    In both cases, prosecutors filed a "habitual criminal" sentencing enhancement against the career criminal, which could result in life sentences if he is convicted. Ricci is being held without bail because he violated his parole, prosecutors said.
    Ricci's father-in-law and next-door neighbor, David Morse, said Ricci is being scrutinized only because of his past criminal convictions -- which include attempted murder of a police officer and aggravated robbery, both first-degree felonies.
    Police "are just making everybody think they're doing a good job; they're just pulling at straws," Morse said of Thursday's charges. Ricci "has got a past he's paid for."
    Morse added that Ricci's wife, Angela, who has told police that Ricci was home asleep with her during Elizabeth's abduction, "is taking it pretty hard."
    Though police refused to comment on forensic evidence, they took a tan golf hat and a large machete from Morse's mobile home last month.
    The only witness to Elizabeth's June 5 abduction, her 9-year-old sister Mary Katherine, said the man who took her sister was wearing a tan hat. Police also impounded Ricci's 1990 Jeep Cherokee, which he received from Elizabeth's father, Ed Smart, as partial payment for handyman duties.
    Also Thursday, Dinse continued to discount a letter received by Ed Smart that said Elizabeth's captor was seeking to negotiate her release.
    "We've looked at the letter; we know its contents," the chief said. "The contents are suspicious."
    Dinse did not explain why police had not tested the letter for forensic evidence.
    Family members said they had not pressured police to file charges against Ricci.
    "We have let the police go forward on their own," said Elizabeth's uncle, David Smart. "We feel law enforcement has done a good job."

Handyman Charged With Robbing Smart Home; Police Say Kidnap Link Unclear

July 11 — There is a "connectivity" between theft charges filed today against a handyman who worked in the home of Elizabeth Smart and the investigation into the disappearance of the 14-year-old Utah girl, police said.

Salt Lake City police Chief Rick Dinse said, however, that police were not ready to charge the handyman, Richard Ricci, with any involvement in the abduction of Elizabeth, and said the 48-year-old ex-convict is not the only person investigators are looking at in the case.

"There is no question there is a connectivity between Mr. Ricci, these charges and the Smart case, but that does not mean that he's the abductor in this case," Dinse said. "There are other people we are looking at."

Police and the FBI are also investigating other people "surrounding Mr. Ricci," as well as people not connected to him, Dinse said.

Ricci, who has been in police custody since June 17 on an alleged parole violation and is currently in the Utah State Prison, was charged today with one count of burglary and two counts of theft, stemming from a pair of incidents in April and June of 2001.

Ricci Could Face Life in Prison

Because Ricci has a criminal record stretching back 29 years and is currently on parole for a conviction for attempted homicide of a police officer, he has been deemed a habitual criminal and all of the charges have been enhanced to first-degree felonies, Salt Lake County District Attorney David Yocom said.

A conviction on any of the charges could result in a sentence of up to life in prison for Ricci, Yocom said.

A preliminary hearing on the charges could be held Friday or Monday, Yocom said, but Ricci is not eligible for bail because of the alleged parole violation.

Police have said that Ricci was one of the first people they talked to after Elizabeth disappeared on June 5, but he was not identified as a focus of the investigation until after his arrest on June 17 on the alleged parole violation.

"If I could charge him, I'd charge him," Dinse said today. "That doesn't mean I don't have anything linking him to the case, but if I could charge him and we could prove it, I'd charge him today."

Ricci and his wife have both maintained his innocence. His wife, Angela Ricci, has said he was in bed with her the night of the kidnapping.

Police say a gunman took Elizabeth from the bedroom she and her little sister shared in the middle of the night. Details of the abduction came from the younger girl, 9-year-old Mary Katherine, who pretended to be asleep during the kidnapping.

Smart Dad Backs Off on Letter

Elizabeth's father, Ed Smart, said for the first time today that he believes Ricci might have been involved in the abduction.

"The fact that Richard was involved in these items, certainly makes him a potential [suspect]," he said. "I am completely behind the police and the FBI in this investigation and, you know, their main focus right now is on Richard, and I certainly believe that it's possible that Richard was involved."

However, police sources told ABCNEWS that investigators are frustrated by the lack of physical evidence linking Ricci to the girl's abduction.

Smart admitted today that he doesn't believe a letter claiming to be from someone with ties to his daughter's kidnapper is genuine, but he remained firm in his plea for the abductor to reach out to him.

"I would love to hear from whoever out there is holding her," he said today on ABCNEWS' Good Morning America.

On Wednesday, at the family's daily meeting with the media, Smart said he had received an anonymous letter he thought could have been from someone who knew the kidnapper, and that it had spurred him to make a plea to the girl's abductor to communicate with him and tell him what he could do to get Elizabeth back.

He said police had also received a copy of the letter by fax, but they had not told him whether they believed it was real.

The news caught the Salt Lake City police off-guard.

"We have not received a copy of the letter," police department spokesman Sgt. Fred Louis told ABCNEWS.com on Wednesday. "Nothing like the letter Mr. Smart described has been faxed to us. It's a total surprise to us."

Dinse said today that police have a copy of the letter and have looked at it, but do not believe it is credible. Police say they receive dozens of letters a day related to the case, but have yet to receive any they deem credible.

Clothes Don’t Match

Smart declined to go into detail about the letter on Wednesday, but today on Good Morning America he agreed to describe what it said.

"It specifically said it was a person who received a phone call supposedly from the captor saying that he wanted to release Elizabeth, saying that he wanted a way out," Smart said.

However, there were details in the letter that made Smart immediately believe it was not real, such as its description of what the missing girl was wearing.

"The thing that probably made me feel that it was less credible was there were issues with what she was wearing that I know she wouldn't be wearing," he said.

You are making a lot of assumptions. I'm sure that the father and most people are assuming he is talking about what she was wearing at the time of the abduction. Obviously, she could be wearing anything/nothing now.

Issues is a very common word in some industries including real estate. So he used it. So what? That doesn't mean anything.

Ed Smart said repeatedly in his first news conference that he didn't think it was credible and the police do not believe it is credible. Why are you hanging on every word?

She also said she loved her husband and the love between them was holding them together through this ordeal.

While I think it's too early for police to have enough evidence to compel her to cut a deal, her statement eerily reminded me when I get comments from people that they will always stand behind me for what I have done for them, I always cringe, because that's usually a sure fire sign it won't be long before they're stabbing me in the back.

Did the Smarts ever make a report to the police regarding the items stolen by Ricci?

If memory serves, in the press conference yesterday, the chief initially said that a report hadn't been filed, but then reversed himself moments later after some coaching from one of his people.

I imagine that Liz, being scared out of her wits, had to tinkle and the perp allowed her to do that. That also potentially links to something else the Chief said as quoted in an article Brigette posted awhile ago i.e. Ricci had no compunction about being in other peoples homes while they were asleep.

Here here, Jolly, well said! Yesterday this thread was blown to and fro by all the smoke in this case, the letter, the family did it, Ricci is innocent, et al. Enough already.

Not that I'm aware of.

Was it posted here or reported elsewhere that Mary Katherine saw the abductor and Elizabeth in the bathroom when she got out of bed to watch what was going on?
The bathroom topic came up when it was being discussed on the WHAT IF's...what if she got up to go to the bathroom...

Not much being said today about the story. Watch for another tidbit to be thrown out by the family to the starving media for the weekend.
Wouldn't surprise me..

Come on, Jolly.....this was a kidnapping in a house full of sleeping family members, not a dinner date. Do you REALLY think that an armed abductor who was making death threats would fall for "I've gotta tinkle"?

I can't wait until parsing and analsis of Ed Smarts press conference begins. This was a gut wrenching plea by Ed to Ricci to come clean and to answer the questions about the vehicle and to clear himself if he can.

Let the twisting and distorting begin!

Excellent news conference, Ed Smart placed the burden square on the shoulders of Ricci to clear himself by answering LE's questions about the Jeep between May 30 - Jun 8. Ed pointed out that he has believed things Ricci has told him in the past and now found out he was lying to him. He called on him as a human being to come forward now and tell the truth so that Elizabeth can be returned to her home or the family can know the truth and go on. Ed reiterated they still believe accomplices are holding Elizabeth and she can be returned safely to her family.
