If Larry has one incriminatory fact against Cheney other than that he was CEO at a time when the company made an accounting decision that was merely disclosed in a footnote, that may or may not be within the confines of GAAP (admittedly with standards that are inadequate and are soon to be changed), Larry didn't disclose it here. The leitmotif of Larry's comments is that he was on a fishing expedition because it was possible that Cheney could be tarred with something, probably due to the work of the SEC for which Larry could take credit for, if and when it occurs.

KLAYMAN: Well, we're looking into that. We're going to look into it. And if there's something there, we will proceed, because, again, no one is immune from prosecution. But let's see how the facts develop. Let's see if the statute of limitations has run yet. And we'll take a look at it. Government agencies won't do the job, we have to do it, Wolf. He is INCREDIBLY vile.

From Larry's past ventures into the courtroom, I'd say this is S.O.P.
