If the ISPs monitor e-mails at the behest of the Gummint, they will be doing so under color of law.

Accordingly, any information they obtain without a warrant will be inadmissible in a court of law (and may well trash an otherwise fruitful investigation/prosecution) and will expose them to criminal and civil actions for their violation of the Fourth Amendment rights of those they spy on.

As the song goes, "Let It Be Me," if I can prove it. I certainly could use a financial hedge against the recent downturn in the stock market.....
