State Can Track Sex Offenders, But Not Publish List

LANSING -- - A federal judge ruled Tuesday that the state can register and track convicted sex offenders as long as it doesn't make that information public.

U.S. District Judge Victoria Roberts reversed part of her June 3 decision that the registry was unconstitutional. Her new decision allows the Michigan State Police to keep a sex offender registry limited to law enforcement agencies.

Excuse me, but "the State" is the people. If you say "the State" can keep a list, but you don't allow the people to see it, then "the State" is committing a breach of trust from the very constitutency from which it derives its existence.

The Libertines scream about "Statism" all the time, but they are usual in left field (literally). "Statism" occurs when the STATE tries to divorce itself from the oversight of the very people it was created to serve.

Not technically. Especially not in use in the U.S. Constitution.

You're wrong. Does 'from the consent of the governed' not mean anything to you?

The state derives it's powers from the people. The people derive their rights from God.

Roberts had ruled that Michigan's public list violated the 14th Amendment, which guarantees the right to due process.

If these are convicted offenders, as the articles states, they've already had their "due process" under Amendment 14.
