And the parents will find out as much if and when they try to file suit. There will be no suit. The parents will be trying to find someone willing to go on a contingency...lol

Pfft. I won't say never - there's a lot of ambulance chasers out there who might think to try this case in the papers and embarass the school into giving up a quick and dirty settlement to make it go away. The school would be silly to do so, but they'll probably look at it from a cost-benefit standpoint - will it cost more to go to court and defend it, or to settle the case?
Settlement or no, I think you're right - these folks will never get a final judgement from the courts in their favor.
