Its wrong. But as we observed in the Briney case, the good guy had to give up everything he owned (and was trying to protect) to the bad guy.

I remember reading about what happened in Skidmore. The sheriff was heard to say,"...to bad about the Silverado."

Generally speaking, these are called man traps. If you're going to set a booby trap, it doesn't have to be lethal. You can replace the shot/nails with vials of gentian violet. If someone sets it off, just put out an APB for "the blue guy".

McElroy's attorney, Mcfaden, was a legendary fixer. I don't think he is still alive however.

I remember this case and thought it was and infringement upon ones rights to defend ones property at the time and still do. But I've been wrong before.

I was a cub reporter in Fort Dodge, IA., my first real job out of school when this happened.
In my mind, the Briney case made it clear you cannot protect property by lethal means.
I think Briney was from Eddyville, IA.

Now, let's take a "for example"...
For example - some guy is burglarizing your place... you catch him, and he "disappears"... how would anyone know you were involved in the "disappearance"??? I mean, it's not like a burglar would leave the house and say, "Honey, I'm going to go break into houses now... if I'm not back by morning, call the police and tell them to check 151 main street, ok? Bye..." or would they???
;0)
