Sheikh Omar appeared in court: HE'S LAUGHING AT US

KARACHI, March 10 (PNS): Sheikh Umer Saeed, the main accused in Wall Street Journal reporter Denial Pearl's murder case, appeared in the court of Judicial Magistrate Irm Jihangir here on Saturday.

Shaikh Omar who was arrested in Lahore on Feb 12 by Punjab Police and later was shifted to Karachi was brought to the court under strict security arrangement.

Omar's appearance was to allow the statement of a witness who identified him to be formally recorded before the court and to let his lawyer cross-examine the witness, a taxi driver. But his counsel Saiful Malook refused to cross-examine without having a detail meeting.

Earlier, the taxi driver, who drove Pearl to the restaurant, recorded his statement in the court under section 164. He told the court that Shaikh Omar had forcefully seated Daniel Pearl in his car.

Shaikh Omar however rejecting the statement said that the Taxi driver had given the statement due to intense police pressure.

The hearing took place in close doors and the court adjourned the hearing till March 12.

Meanwhile it is reported that The US government has sought Ahmed Saeed Omar Sheikh's extradition for the killing of an American, who, along with some other Western tourists, was abducted in occupied Kashmir some years back, and not in the Daniel Pearl kidnap and murder case.

However, sources said that the government would hold Omar's trial in the Pearl case in Pakistan if it was able to find sufficient evidence to get him convicted by Pakistani courts otherwise he would be extradited to the United States. Omar's point of view is that he remained in the Indian jails for four years and was charge-sheeted in the tourists' kidnap and murder case but no trial was ever held.

His stand is that he cannot be tried in the same case in the United States because nobody can be subjected to double jeopardy under the Americans' own law. He says that the Americans are working to try him in the same case.

The whole court system in Pakistan is a complete joke. Sheikh Omar was shopping for a wide screen t.v. on the black market when he should have been extradited to the U.S. for the kidnapping in 1994.

The U.S. better not let up on this, although at this point, the only sure hope for justice is an exploding cell phone courtesy of Daniel Pearl's brothers.

He knows too much about the Pakistani regime to be extradited. He'll reveal too much about Musharaff.

Looks like the sort of setting where people like him get assassinated. Uncontrolled. Karachi is big & nasty place-violent town. I don't think he will live long. There's a cop in the picture with auto pistol drawn-looks like a Berreta.

Hey, Omar! You can't be tried twice for the same crime in an American Court! You ain't in one...yet!

True. By allowing a public airing of his being nailed by the taxi driver, his guilt is being established though you would agree?. I don't think he's laughing I think he's gotta be nervous. I still hope he will be extradicted.

Well said. Pip pip and all that. The Aussies have fought along side us in every war in the 20th Century. Now looks like they will repeat this tradition in the new Century. Ya gotta love em'! And man can those girls down-under hold their beer!

I do regret they surrendered their personal arms so easily after that moron on Tasmania killed all those people. Idiots everywhere, not just in USA...

HE'S LAUGHING AT US

He's continued his cocky attitude ever since he swaggered into the police station a few weeks ago to "turn himself in." He was fresh from a weeks' stay at the villa of an ISI Commander--where he originally "turned himself in."

The guy has some serious muscle behind him when you look at the pro-Al Qaeda history of the Pakistan Inter-Service Intelligence Directorate (ISI).

BTW, looks like the Paki Press is also having some fun with the Western infidel reader. Sheikh Omar is given four differenct handles in this little 300+ word article--and the "Related Links" frame is packed with a couple of other Omars just to add to the carefully orchestrated confusion.

Even seasoned news-readers will find it a bit difficult picking their way thru this confusing thicket.

They talk about our drug war as if we were fascists (well, I guess the WOD is fascist).

Regardless, the point was that like the Brits and Israelis, the Aussies will always be with us.

WRONG!

While in the Navy, I sat through lectures by JAG Corps types that explained that Virginia or California could try a serviceman for a crime commited off base and, if an O.J. jury let the obviously guilty b@astard off, the Navy could prosecute the same crime under the UCMJ without violating the double jeapardy rule because the case would be tried by different sovereigns.

Pakistan and the United States are definitely "different sovereigns". Let him keep laughing. The last laugh will be on Omar.

My myopic view just omitted them from any projection of power & world events. I was very unhappy to read this last week on FR, they had sold an aircraft carrier to the Chi-Coms, who promptly scrapped it! Who knows, details may be wrong. I just think we can't really count on very many other nations for what is about to unfold. This will get very big, very, very big.

Domestic issues aside, Mr. Bush will do what needs to be done-he may hesitate, but I think public pressure & his own instincts will make things happen. There also may be bigger fish to fry & that particular rag-head may just have to hang loose for a while-but he probaly will hang some where!
