This always seemed to me to be rather strange logic. If we are going to say that a certain action is criminal and results in the loss of life, liberty, or property then why would we be lienient the first time someone breaks a law? If they dont respect the law itself, then should we not then make the punishment severe? Then we could hope that the severity will correct behavior.

Would you say be lienient to a first time murderer? Heck no. That we say that of drug offenders reveals the truth of the law which is that it exists to harass citizens, and offer an excuse to seize property.
