FSS 893.13 Prohibited acts; penalties.--

9. To acquire or obtain, or attempt to acquire or obtain, possession of a controlled substance by misrepresentation, fraud, forgery, deception, or subterfuge.

10. To affix any false or forged label to a package or receptacle containing a controlled substance.

(c) Any person who violates the provisions of subparagraphs (a)9.-11. commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

I can see your point but it really is kinda useless to guess what the charge is going to be until such time as a prosecutor files a complaint. Sometimes there are multiple charges and whatnot that they consider.

Fla.- Gov. Jeb Bush's daughter was charged with prescription fraud Tuesday after she was arrested at a pharmacy drive-thru window while allegedly trying to buy the sedative Xanax. Sedatives? Xanax? Downers?
