Actually, I'm amazed that this came out of the Ninth...I was quite surprised to see this decision and I suspect it won't be overturned.

That quote, Waspman, is paraphrased from Edmund Burke, but in this case, I am afraid it does not apply. I think the following is far more to the letter:

I believe this 9th DCA opinion is a success on two fronts: this court is notoriously leftist, and it actually voices REASON. Maybe they know the secret that the BLM is known as the Bunch of Lazy Morons. The enviro-wackos know this, and rely on this phenomenon.

I think what the ruling states is that cattle cannot be prohibited from grazing on public lands simply because at some time 200 years from now, an endangered species (so-called) may or may not decide to take up residence on those lands. This cuts the nuts off the Clinton application of the ESA, wherein no use of the public lands can be allowed if, in the estimation of far-left wack nut environmentalists hired to fabricate facts, an endangered species could conceivably appear on the grounds sometime in the unspecified future.

I'm not so sure that this is as big of a win as they think.

Maybe not, but it's still nice to see the good guys win one for a change.
