Sorry... but if the US is attacked, we are at war whether or not congress does anything. If we get nuked by Russia or China, we would be at war even if Congress had been wiped out in the first strike. Once attacked, the President does indeed act as Commander in Chief- he does not have to wait for approval to respond.

Taking an action without being attacked first, IOW, taking aggressive action... requires either congressional approval, Letters of Marque and Reprisal, OR a declaration of war.

Read Senate Joint Resolution 23, which passed on 17 September and was incorporated into the Anti-Terrorism Act that was signed into law on 18 September. Regardless of what you think. we are legally at war -- unless the Supreme Court declares the 24-year-old War Powers Act to be unconstitutional. (Although the Court should do that, it will not. Unlike you, I know all eight of the Court decisions having anything to do with "wsar powers.")

Second, it is not necessary for the US to be in a declared war before those who attack us can be classified as "illegal combatants." The Barbary pirates qualified for that definition both before and after the US declared war on them in January, 1806.

As I said before, you are wrong on this. Quirin controls. While you have every right to be wrong for your own purpose, your posts based on failure to read up on the subject may deceive other FReepers into believing things that are not true.
