The Justice Department has apparently ruled out charging him with treason, given the demanding legal standard set by the Constitution and the difficulty of finding witnesses from the Taliban who would testify against Walker.

To which mdittmar says

So, you want a Freep AGAINST THE CONSTITUTION OF THE UNITED STATES?

The Constitution says,

Article III

Section 3.

Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.

My personal opinion is that Walker should be given the same sentence as Philip Nolan in "The Man Without A Country." His family should be sentenced to therapy with Dr. Laura.
