Grand Jury Compromised

Fox is reporting that a member of the Grand Jury investigating the drug allegations in South Fl.had alerted OJ about the DEA's intent to search his house.

Let me guess. The member of the Grand Jury that tipped off O.J. is a black liberal who is a big believer in "jury nullification." I'll eat my hat if I turn out to be wrong.

I saw this on FOX. Oh, brother. Isn't it something. Perhaps it's actually a good thing. I am glad it's getting some publicity; it seems as if the Feds are not going to whitewash or bury the incident or respond to it with a slap on the wrist. Time will tell, of course. But perhaps it will wake some people up.

Sam,

The theory of jury nullification is a cornerstone of English Common Law and American jurisprudence.

It is another of those "separation of powers" things. Remember those, they were part of the Old Republic and still have a small part to play in today's government.

Grand juror accused of alerting Simpson to planned search

MIAMI -- Prosecutors accused a federal grand juror Monday of leaking information about a planned search of O.J. Simpson's home as part of a drug investigation.

John Acosta, 31, was charged with obstruction of justice for providing advance warning to Simpson's associates.

Acosta was scheduled to make his initial court appearance later Monday before a federal magistrate, and prosecutors and the FBI was scheduled a news conference to follow.

Yale Galanter, Simpson's attorney, told reporters following the search of Simpson's home that he had been warned that authorities might serve a search warrant on his client. He declined to elaborate.

Galanter had no immediate comment on the charge against the juror.

Simpson's house was searched last week by federal agents as part of the investigation into an Ecstasy drug ring also tied to money laundering and satellite TV equipment theft.

Federal agents have arrested 11 people to wrap up a two-year investigation called Operation X. Simpson was not among those taken into custody, and his lawyer said the former football star had done nothing wrong.

Acosta heard testimony and saw evidence about Andrew Anderson and his alleged drug organization, FBI agent David Magnuson said in an affidavit filed under seal Friday. Anderson was among those charged in the case.

The affidavit said Acosta first denied leaking the information but later told authorities that he alerted Zenaida Galvez, another defendant, to the investigation and indictment.

Acosta was a friend of Galvez's boyfriend, said FBI spokeswoman Judy Orihuela.

Kind of makes you understand why Bush Admin goes the way of military tribunals instead of the courts. I would believe in jury nullification passionately if the jurists were at least high school graduates, get no compensation from the govt (fed,state,local) in the form of salary or benefits, own real property, and they have an IQ of more than 100. Unfortunately, those are the things that get you off of a jury today.

The inviolate seal of secrecy of Grand Jury deliberations has absolutely no bearing on the concept of Jury Nullification. This person should be punished to the fullest extent of the law.

I'm aware that jury nullification has its purpose, but I believe it was misapplied in the O.J. case.
