But that old document is pretty much void where prohibited by law now anyway.

There are many factors that make the two cases different. The Russians had no reliable allies inside the country. They did all the ground-fighting on their own. Also, there was no sense among the populace that the Russians were coming to liberate them from a greater evil, such as the Taliban. However, it must be said that the American military outperformed the Russian military about a billion percent or so, given our natural technological edge and the technological edge we gained 20 years after the Russian incursion into Afghanistan.
As for nation building, I don't see a problem with it, as long as US ground-troops aren't directly involved. Just as we "conquered Afghanistan" using proxies while protecting them from the air, we can keep our planes in the sky to back up any other nation-building force, such as Turkey.
Hmmmm... Haven't you heard? It is a Living Document subject to interpetation by (Liberal and only Liberal) courts. (Or at least that is what we are lead to believe by the Media)

Everytime I think of a jury trial I have visions of Johnny Cochrane and Alan Dirshowitz in a courtroom full of diaper heads dragging on for months with judge Ito playing solitare on his laptop.
What next, Senator Leahy? Demand the Marines carry Miranda warning cards to read Osama his rights? I can imagine it now. "You have the right to remain silent. You have the right to an attorney. If you cannot afford an attorney . . . Oh, forget it. BLAM!"
Every time Leahy asks him why he's "abusing" his powers, the should just tell him that thousands of Americans are alive today because they've taken the stand they have taken.
If Leahy brings up the military tribunals, Ashcroft should ask him if he's prefer to travel to Afghanistan himself and sort through who should and who should not receive an full blown American trial.
Leahy needs to be shamed out of his arrogance!
1. He is incompetent on history. In his position as Chairman of Judiciary, he d*mned well ought to know about a unanimous Supreme Court decision that says his position is wrong.
2. He is stupid if he thinks the press will ignore his incompetence. For sure, the lamestream media is ignoring his incomptence, but the story of the unanimous Supreme Court decision IS getting around, as witness this article.
3. Senator Leahy is going soft on terrorism, and he's undercutting his own nation in a time of war because he thinks he and the Democratic Party can gain from that.
The best way to prove that Leahy and all others who participate in this shameless stupidity and lying are wrong, is to hang the label "soft on terrorism" around their scrawny necks in the 2002 elections. The interesting thing will be to see whether Bolshevik (excuse me, Majority) Leader Daschle buys into this scam. Second only to Utah, his home state voters will get seriously riled when he goes "soft on terrorism."
