I did a little research on FDR using military tribunals and found the following (if this is included in the referenced article I'm sorry for being redundant):
-FDR used a military tribunal in a specific case, he did not authorize the use for a broad catagory of people.
-FDR went to the Supreme Court for opinion (again on one specific case, not blanket powers) and did not authorize the tribunal solely through an executive decision.
-and as mentioned before, these were German spies and we were officially at war with Germany (congress had declared war).

It's time for the U.S. to fish-or-cut-bait on the UN. There is the substance called International Law with the Hague to prosecute such as the terrorists. By inserting the first-person, Bush has declared himself to be above all others on the planet. Contrary to popular opinion, anyone can be declared by Bush to be a terrorist.
