I don't understand the concern by some of the lawyers and judges since this applies only to non-US citizens!

It concerns me, even though I support it in principle, because there has been no formal declaration of war.

I think the formal declaration was on 9/11/01 when they hit us. Seriously, your concerns are valid. However, I must assume that there are good reasons the administration has not asked for a Congressional declaration. Perhaps, the Geneva Convention rules would hinder us in this endeavor. Maybe it's as simple as not being able to get the votes needed. Maybe it's so the insurance companies can't weasel out of paying claims. For now, Dubya said it was war. Rumsfield is executing this as a war. We are at war. Until such time as this administration proves itself unworthy of my trust, they have it.
