I wonder, since all ammendments refer to the people as a wholeDo they? The 3rd, 5th, 6th, 7th and 8th amendments don't mention "the people". I believe the forumula they use is when the words "the people" or "the right of the people" appears they consider it as a qualified right applying only to citizens. If a clause is unqualified like the 5th which simply says "person" or the 6th where it just says "the accused" its considered to apply to citizens and resident aliens alike.

Non citizens do no have the right to take our country away from us or to destroy it or come here and kill us. A non citizen has no allegience to this country or the Constitution, they have rights we let them have, and that can change as the need for that changes. Self defense and common defense are mentioned for a reason. Back then we didn't give "rights" to the Englishmen who were landing on the shores and invading the cities, they were shot and weren't given due process.

It concerns me, even though I support it in principle, because there has been no formal declaration of war. I think the formal declaration was on 9/11/01 when they hit us. Seriously, your concerns are valid. However, I must assume that there are good reasons the administration has not asked for a Congressional declaration. Perhaps, the Geneva Convention rules would hinder us in this endeavor. Maybe it's as simple as not being able to get the votes needed. Maybe it's so the insurance companies can't weasel out of paying claims. For now, Dubya said it was war. Rumsfield is executing this as a war. We are at war. Until such time as this administration proves itself unworthy of my trust, they have it.

The precedent for this is long established. I note that this precedent is only for foreign nationals. The danger is that this would be used by some future administration to stifle dissent within the nation. At this time I believe this action will need not necessarily be a major problem for America but it is definitely something that should be carefully watched in the future.

PS is this an executive order or a proclamation, and what is the difference?
