sue their spouse for NOT having sex

There is no comparison between the two. In one case, a husband and wife negotiate the times and frequencies of sex. That is a legitimate part of marriage.

In the other, someone has stolen what isn't theirs. It is not different than shoplifting.

What if the spouse who is cheating is still having sex with his or her spouse? Then it seems nothing was stolen since the spouse is still getting it.

And I can assure you, no spouse in America readily agrees to NOT have sex any more. And I wasnt talking about only getting it a couple times a year, im talking about spouses who refuse to have sex ever. And trust me, it happens far more than you would ever guess.
