You neglect the fact that public schools are controlled and funded locally. The feds have little influence other than curriculum standards etc. If the people of Wisconsin want the kids to wear little hats with propellers on them, that is what they will do. The majority rules. It is up to the minority opinion to change that, not some Boston lawyer with the ACLU.
