I always read that as it being Jesus's option. In other words, Jesus is the judge. I do not see it as a formulaic process. Most of the time it looks to me like Jesus used some common sense and went beyond appearance and ritual. Atta had to stand before him and be judged. In Atta own heart and mind, do you think he saw his actions as sinful? Or very sacred and religious?

Well that's an interpretation that I have never heard. I'm sorry but it doesn't work that way. To put it in simple words, Jesus showed himself to be true God. He died with the burden of our sins so that we can be forgiven. Through His suffering, death, and resurrection we can know eternal life with God. But (this is the most important part) He is the only path. There is no other way. That path requires that one accept that He is true God. There aren't different versions; one way and one way only.

The Jews believed that killing Jesus was "sacred and religious" he was a heretic according to the way they read the law.

The Pharisees of old and Atta might be comparing notes tonight but I don't think it's taking place in paradise.

It doesn't matter what Atta thought. His actions will be judged by God Almighty when the time of Judgement comes.  And Atta hasn't seen Jesus because Atta is dead.  The Scriptures say when you're dead you have no thoughts or memory, you're dead until the resurrection.  Let the Muslims make a mockery of that piece of crap called the Koran to get it to say whatever they want it to.  If you're going to use Scripture know what you're talking about.  It's not a book to prove whatever insanity somebody wants to believe.
