The Minnesota Court of Appeals reversed Hennepin County Judge Sarah West's decision to throw out a jury's guilty verdicts against Abdifatah Abdulkadir Yusuf, whose health care company fraudulently billed Medicaid for more than $7.2 million.
In a ruling filed Monday, a three-judge appellate panel ordered the case returned to Hennepin County for reinstatement of all six guilty verdicts for aiding and abetting theft by swindle.
The appeals court rejected West's conclusion that Yusuf's brother, Mohamed, might have orchestrated the fraud without Yusuf knowing or helping. She cited Minnesota's circumstantial evidence standard as needing to rule out such a scenario for a conviction to stand.
The appeals judges determined that when considering all the evidence together, the only reasonable conclusion was that Yusuf knew about the fraudulent activity and intentionally helped his brother commit the crimes.

Another witness testified she provided four to six hours of overnight supervision for her mother, unaware that Promise was billing for as many as 12 hours.
Jurors also heard evidence that Yusuf personally received more than $1 million from the company's accounts. Investigators identified more than $400,000 in retail purchases, including spending at Nordstrom, Canada Goose, and Feldmann Imports.
The jury found Yusuf guilty on all six counts and determined that aggravating sentencing factors existed.
But before sentencing, West granted a defense motion for judgment of acquittal, effectively wiping out the guilty verdicts.

Too bad they can’t issue an arrest warrant for the judge.
She understands the unwritten law that bag men are there to safeguard plausible deniability of the principle. Fortunately, that is not the law.
Didn’t they demand her legal reasoning to be explained in detail and on fact?
Damn! Dirty ‘judges’ everywhere.
