Red State’s Supreme Court Shuts Down 27-Year-Old Lawsuit Against Gun Manufacturers

A legal battle that began before the iPhone was invented ended Thursday as the Indiana Supreme Court declined to hear an appeal from the city of Gary over a ruling that killed a lawsuit against 11 gun manufacturers.

The city initially filed its suit in August 1999 seeking not just money for alleged damages caused by the gun manufacturers’ “negligence,” but also for the court to order the manufacturers, including Smith and Wesson, Glock and Beretta, to take various measures that anti-Second Amendment groups had not been able to achieve via legislation. In a statement released Thursday, Brady United, formerly known as the Brady Campaign and Handgun Control, Inc., decried the court’s 4-1 decition to reject the appeal of a December ruling from the Indiana Court of Appeals.

“What are the gun industry defendants so afraid of? We feel so disappointed today for our client, the City of Gary, which has made near insurmountable strides in reducing gun violence in recent years,” Brady United President Kris Brown said in the statement. “Meanwhile, they have also fought hard for the last 25 years simply to tell their story and have a jury of Hoosiers decide what accountability gun companies should face for the public health crisis and trail of terror their negligence created.”

“Former Democratic New York Gov. Andrew Cuomo, who was secretary of Housing and Urban Development during the Clinton administration, also got involved in the litigation, vowing that gun manufacturers would face “death by a thousand cuts” if they didn’t accept the terms demanded by anti-Second Amendment organizations.

“If you do not sign, your bankruptcy lawyers will be knocking at your door,” then-Democratic New York Attorney General Eliot Spitzer told Glock at one point regarding a settlement”

This would have opened up the proverbial can of worms if it had gone through. Where would this slippery slope end? But it would start with the sale of anything that can be related to death. Cars, boats, houses, motorcycles, bicycles, falls...anything you can buy or do and have something happen. You can’t go ice skating, skiing, sledding, water skiing, flying, walking or jogging...

It will never end. And ambulance chasing lawyers are a dime a dozen. I’ll bet someday they will get divorce proceedings into it with anxiety or cruel and unhuman punishment.

“Our” Legal System has become a total Joke.

One can generally only obtain as much Justice as one can afford.

Before it was ‘Handgun Control” it was the “Coalition to Ban Handguns”. They changed the name because it was too descriptive and wouldn’t get popular support.

Also, first they wanted to ban “assault weapons”. Now they want to ban all guns. Give them an inch and they destroy a country.

In other gun news, the “AK Guy” is leading the polls in Dis 23 in Texas.

In the new Congressional District 23, Democrat Katy Padilla Stout has raised $238,000, with only $145,000 cash on hand. She is expected to lose in November to Republican Youtuber and gun rights activist Brandon Herrera. who has raised more than $1.5 million, with more than $305,000 cash on hand. Former Republican U.S. Rep. Tony Gonzales held the seat until he was forced to resign after two sex scandals, including one involving a former staffer who killed herself.

The way I heard it, maybe I don’t understand this correctly, but a strict product liability is sort of the holy grail for bottom feeding attorneys. It goes far beyond firearms.

Think “lawsuits against General Motors” because say, you were driving their product when you got that 3rd Drunk Driving award with Hophead cluster. It’s their fault too, you see. And GM has serious money, while you probably don’t.

Such bastardization of the law would bankrupt Hollywood studios, school districts, car makers, medical equipment manufacturers, etc.
