Harmeet Dhillon: Semiautomatic Rifles Like the AR-15 ‘Are Protected by the Constitution’

During a video posted to X on Tuesday, Assistant Attorney General for Civil Rights Harmeet Dhillon stressed that semiautomatic rifles like the AR-15 “are protected by the Constitution.”

She pointed to the Supreme Court’s Bruen (2022) decision and said, “When you look at the historical analysis — and Justice Thomas lays this out very clearly — it is clear that semiautomatic rifles of the nature of the AR-15 are protected by the Constitution and the Second Amendment.”

Dhillon noted that she sent a letter to Gov. Abigail Spanberger (D-VA) warning the DOJ would file a lawsuit if the governor signed the “assault weapons” ban legislation which was passed by the Democrat-controlled Virginia legislature. Dhillon noted that instead of signing the bill by the April 13 deadline, Spanberger “sent it back to the legislature with some minor, technical edits that don’t cure the problems identified in my letter.”

Dhillon went on to note that Spanberger did sign other gun controls, including a “ghost gun” ban, and indicated that law is “going to be analyzed under ATF regulations.”

She said that another bill signed into law by Spanberger “effectively removes immunity from gun manufacturers.” Dhillon described the law as “very concerning” and noted that “it is really designed to put gun manufacturing out of business in our country, and I think it’s inconsistent with federal law because… the right to carry, the right to bear arms, the right to have them in your home and enjoy them for lawful purposes is meaningless if you’re not able to acquire those firearms.”

Automatic rifles like the ORIGINAL AR-15 are protected by the Constitution.

Then introduce legislation to end the NFA of 1934, the GCA of 1968, shutter the ATF. Introduce legislation to get rid of the NICS system because it became apparent that it’s an abysmal failure every time someone goes on a mass shooting and the best the FBI can do is bleat “The shooter was on our radar”. Talk is cheap.

Then they need to pass the same for fork/spoon manufactures, soda pop, energy drinks, candy makers, fast food restaurants, highway and road contractors, knives, screw drivers, pillows and pillowcases, hammers: basically anything that can be related to a death. See how that goes over...

it is the right to bear arms, not the right to bear muskets. And would also include swords in my opinion

She specifically said "semi-automatic", and the NFA does address fully automatic so you would need to keep that part of it.

Bruen says in common use. Not ‘in common use as currently used by the United States military’ which would both knock out AR-15, M-16, and be an ever-shifting landscape of things mostly inaccessible to citizens.

All this VA (and other communist-run state) stuff is trying to get some case law that limits the ‘textual’ and ‘historical’ step in Bruen to somehow mean the opposite of what 2A means and what the Supreme Court wrote. Or make us go broke chasing them around in courts.

SCOTUS unfortunately seems inclined to allow Bruen to die the death of a thousand bad appellate decisions.

We're not getting Kavanaugh's "percolation" of cases reversed and remanded by Bruen, we're getting more turds floating to the top of the leftist appellate court cesspools.
