Trump can suspend refugee admissions, US appeals court rules

March 5 (Reuters) - A U.S. appeals court on Thursday ruled that President Donald Trump had the authority to indefinitely suspend admissions of foreign citizens seeking to enter the United States ​under the U.S. refugee resettlement program.

The ruling centers on Executive Order No. 14163, titled "Realigning the U.S. Refugee Admissions Program," signed in January 2025.

Presidential Authority: The court cited the 2018 Supreme Court decision in Trump v. Hawaii, affirming that the President has broad power under federal law (8 U.S.C. § 1182(f)) to deny entry to foreigners if their entry is deemed "detrimental to the interests of the United States." Indefinite Suspension: The panel concluded that this authority allows for an indefinite halt to refugee admissions, reversing the lower court's finding that the order "nullified" congressional intent.

Non-Reviewable Policy: Writing for the panel, Senior U.S. Circuit Judge Jay Bybee stated that whether the suspension reflects "prudent policy" is not a question for the court, despite the "enormous practical implications" for over 100,000 vetted refugees waiting for admission.

Yes. The President and his Secretary of DHS can make those decisions as per the power given to the President by Congress.

There is nothing in the U.S. Constitution that gives foreigners the right to jump on an airplane and fly to New York and demand to be funded for life if they are afraid of their cowardly shadow.

Critical point that too many on both sides don't always seem to understand. It's not the proper role of the courts to determine whether a policy is good or bad.

In other court news, the D.C. Court of Appeals, in Benson v U.S, has ruled that DC's ban on magazines over ten rounds is unconstitutional.

In the summary of the ruling, the majority appears to adopt what SAF and many others have long argued in accordance with Heller: commonality alone grants Second Amendment protection.

"Because these magazines are arms in common and ubiquitous use by law-abiding citizens across this country, we agree with Benson and the United States that the District’s outright ban. on them violates the Second Amendment."
