Oklahoma Lawmaker Files Resolution Aimed at Banning Sharia Law

A state lawmaker has filed a resolution that would ask Oklahoma voters to consider a constitutional amendment prohibiting the use of Sharia Law or other foreign legal systems in state courts.

Rep. Gabe Woolley, a Republican from Broken Arrow, introduced House Joint Resolution 1040, saying the proposal is meant to reinforce the authority of the U.S. Constitution and protect individual rights in Oklahoma.

Woolley argues the resolution is not about restricting religious freedom, but about preventing what he describes as a political ideology from influencing the legal system.

He says Sharia Law conflicts with constitutional protections such as free speech, women’s rights and personal liberties.

Supporters of the measure point to Oklahoma’s 2010 “Save Our State” amendment, which was approved by voters but later overturned by a federal appeals court before it could take effect.

Woolley says changes in leadership and the passage of time make it appropriate to revisit the issue.

He also cited developments in other parts of the country and abroad as reasons for proposing the amendment, saying Oklahoma should take steps now to avoid similar outcomes.

If the resolution passes both chambers of the Oklahoma Legislature, it would appear on a statewide ballot for voters to decide.

HJR 1040 is eligible for consideration during the Second Regular Session of the 60th Oklahoma Legislature, which begins February 2.
