UCMJ Articles 90, 91, and 92 require service members to obey all lawful orders and regulations.
The discussion of lawfulness within the Manual for Courts-Martial (which provides binding guidance on the UCMJ) explicitly states that the presumption of an order’s lawfulness does not apply to a “patently illegal order, such as one that directs the commission of a crime”.
It also clarifies that acting “pursuant to orders” is only a defense “unless the accused knew the orders to be unlawful or a person of ordinary sense and understanding would have known the orders to be unlawful”.
Therefore the orders cannot be considered illegal in their application unless the troop knew they were so he/she could be tried in a court martial based upon article 92 or 96 that do not have illegal in their description. Illegal can be an assumption and not a fact.
