Abrego Garcia to remain in U.S. for prosecution hearing in Nashville

Salvadoran national Kilmar Abrego Garcia is to remain in the United States through at least late November, according to new filings.

On Tuesday, U.S. District Judge Paula Xinis in Greenbelt, Md. Approved a new schedule that allows him to appear at a two-day evidentiary hearing in Nashville, Tennessee, next week.

Xinis previously blocked Abrego Garcia’s deportation in August.

The hearing will inspect whether prosecutors were “selective” or “vindictive” in their prosecution of Abrego Garcia since the 2022 traffic stop that initially led to federal immigrant smuggling charges.

Additionally, Xinis set a motion hearing before Thanksgiving, on November 21st, to look into the government’s request to dissolve her injunction preventing Abrego Garcia from immediate removal from the U.S.

Senior officials from the Trump administration told the judge they had planned to deport Abrego Garcia to Liberia as early as Friday, October 31st, despite the ongoing criminal investigation in Tennessee.

“If there were no prohibition, we would remove him on Friday,” U.S. Department of Justice (DOJ) lawyer Drew Ensign told her.

8 USC 1324: Bringing in and harboring certain aliens

(1)(A) Any person who-
(ii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law...
(v)(I) engages in any conspiracy to commit any of the preceding acts, or
(II) aids or abets the commission of any of the preceding acts,
shall be punished as provided in subparagraph (B).

My sentiments exactly, this crony Yudge and the entire Rat party could care less about the expense incurred for them to poke the bear, it is nothing but spite directed at Trump admin and the rule of Law.

If they could keep Maryland Man here by any means they and the media could crow about for a few news cycles.

The truth is that he is never leaving. Eventually, the Dems will provide him with “restitution” for his troubles, and he and girlfriend (if she survives) will live happily ever after in Maryland or some other Blue state.

Charge him the $1000/day fine for those that had a deportation order and did not leave voluntarily. I believe that is retroactive to the date of the order.

Go ahead and bankrupt him for eternity.

I’m 100% sure a helpful federal judge would immediately invalidate such a fine . . . and probably require the feds to pay him that amount instead for pain and suffering.

Abrego was in the U.S. legally at the time of his apprehension. Abrego has not been convicted of any crime.

Kilmar Abrego Garcia married to Jennifer Vasquez Sura in 2019. His wife is a U.S. citizen.

He cannot be fined while in the U.S. legally. Ostensibly, Abrego was brought to the U.S. from El Salvador by U.S. authorities to face criminal charges in Maryland.

On October 3, 2025, District Court Judge Crenshaw granted Abrego Garcia’s request for discovery and an evidentiary hearing on his claim of vindictive prosecution, finding that Garcia presented evidence showing a “realistic likelihood of vindictiveness.” The court found that the reopening of a closed 2022 traffic stop investigation days after Garcia prevailed at the Supreme Court created “a sufficient evidentiary basis to conclude that there is a ‘realistic likelihood of vindictiveness.’”

The emergency deportation sought to dissolve the Maryland case days before government authorities would have to present evidence, if they have any to present, at an evidentiary hearing.

The criminal charges in Maryland stem from the 2022 traffic stop. At the time, Abrego was released without so much as a traffic ticket.

Mark your calendar; first of the year Garcia will still be here - first of what year is that? 🤷 The 'Rats have declared it months ago and the 'Rats almost always get what they want... This 'judge' is dedicated to seeing to that. How many times have we foolishly believed that this thug is gone - he is still here. 😒

We should force Garcia to live at the judge's house!

False. His first deportation order was in 2019. The only thing he managed to do to fight it was to prevent deportation back to El Salvador, yet somehow the paperwork said he could not be deported to Guatemala. Regardless, he was not in the US legally at the time of his apprehension, and his two deportation orders were still valid.

Abrego has not been convicted of any crime.

True, but he is going to trial for human smuggling. The video evidence is pretty damning.

He also beat his wife twice and was released without so much as a stern talking to.

I suppose we should just let this illegal alien stay since he skated by for a few years without the law catching up to him, right?
