I really don’t care if they prosecute him or not. He is not longer employed at DOJ.
Now he can spend his days prancing around Dupont Circle with the other flamers.
Nope… DC jurors are 95 % democrat. No conviction is ever going to happen, no matter how they make the charge. Now a J6er who stayed in the velvet ropes? They get a felony indictment from the grand jury for trying to overthrow the US government.
It is all how the prosecutor puts forth the case.
Walking around DC on jan 6....guantanimo. Assaulting a federal cop...return to your law practice.
And they did, and for less.
They overcharged because they wanted to lose the case and be able to blame the grand jury.
It’s a twofer for Deep State.
It’s DC. Yhe juies are as politically biased as the judges. The guy would not be indicted even if he shot the ICE agent.
To me the point of the whole thing was to put the clown through the wringer knowing he’d not be indicted. He’ll think twice about throwing food again, and maybe his buddies will too.

And there’s your problem... If DC courts won’t then federal courts should take the case elsewhere.
Prosecutor should have spoken more slowly, made exaggerated lip movements, and used short words when speaking to the Grand Jury.
I've an idea... let's burn DC to the ground and reboot the REPUBLIC in Nebraska.

I thought the (former) prosecutor was trying to demonstrate that a Grand Jury which—”could indict a ham sandwich”—couldnt do it in the District of Corruption.
Can he now sue DoJ for millions?
But the worst thing of all is..........a Subway Sandwich. Which, IMHO, requires a loud Barf Alert before you HURL it.
Misdemeanor assault would probably rate zero jail time, or maybe a week at most.
But yes, it was silly overcharging.
You think he will get the Contractor’s position back at DOJ? I dont think so, the Merit Protection Board doesn’t cover them at all.
But that doesn’t stop the Dems from just hiring him somewhere else, they are good at that.
Not surprised. I wouldn’t have voted to indict. He got fired from his DOJ job. That’s punishment enough.
