Man convicted in 1981 Pearl River murder to remain jailed as judge denies bail change

A judge has refused to reduce the bail for the paroled murderer of a Rockland teenager who is accused of groping a woman at a Cortlandt dog park.

Robert McCain, 64, appeared virtually before Westchester Judge Robert Prisco from the county jail on Friday, Aug. 8 as his lawyer Robert Nachamie argued that inconsistencies in the alleged victim's account and McCain's good behavior on parole meant he should be released without bail.

But Prisco consented to Assistant District Attorney Mollie O'Rourke's request to keep the bail amount the same. O'Rourke argued that other than the victim's confusion about the date the incident occurred, her accounts of the alleged groping had all been the same and that, as a convicted murderer under lifetime supervision, McCain's "behavior is expected to be completely above board."

McCain and the woman were acquaintances but did not otherwise have a personal relationship, O'Rourke said. On July 4 he sent her a voicemail asking that she bring her dog to the dog park. When she arrived the prosecutor said, McCain insisted that she sit close to him, "then put his arm around her and with his other hand reached under her shirt and groped her breasts."

How can it be just manslaughter? The second perp stabbed her repeatedly when he was aware she was not dead. Sounds like first degree premeditated murder to me. As the first perp was part of the crime the same charge would be applicable to him also.

Both he and his accomplice were convicted of 2nd Degree Murder. There is NO WAY these bastards should NOT have been executed.

State and Federal chrages involved.

In addition to the state case, Mangione is charged with murder in a federal indictment that seeks
the death penalty. In another, more behind-the-scenes battle, prosecutors in venues, state and
federal, have said they intend to bring Mangione to trial first. The order of trials has yet to be
worked out.
