Nope, this was a legal CYA move on Pensk’s part. If the truck had a accident with them in the back, they will be listed on the lawsuit as sure as hell, especially if it was an illegal that got hurt.

To rent the truck they had to sign their standard rental agreement which clearly states no one is to be in the back when the truck is moving. ICE had to sign that to get the truck, this isn’t anything about the illegals whether they agree or disagree with ICE doing it, it’s that they flagrantly violated the moving vehicle policy and was caught on camera doing it.

Penske’s legal department is the one who did this. The higher ups probably didn’t even know it happened until now, but the lawyers had to do it or next time people will use the video as evidence that Ryder was okay if SOME renters did it, but not others.

You really have to be in business now to understand just how nuch BS we have to go through to CYA on every little detail to avoid ambulance chasers and droves of people just looking for a quick buck.

It is Charlie Yankee Alpha. No rental company (U-Haul, Penske, Two Men and a Truck, Ryder, et al) will allow humans to ride in the cargo area of a rental truck. Any injuries or deaths caused by this will result in litigation. Having agents in the cargo area is prohibited. The Captain does not want his people sued if someone is killed in a standoff that takes place in the cargo section while the vehicle is moving. Insurance will not cover the deaths of DHS agents in the cargo areas of the van should something happen. California Vehicle Code 21712 (b) states, "A person shall not ride on a vehicle or upon a portion of a vehicle that is not designed or intended for the use of passengers.". Most states have similar rules. If DHS used a standard white GM, Ford, or Stellantis 12/15 passenger van, it would be legal. Using a cargo box van is illegal because they are not designed to carry people in that section.

If someone is riding in the cargo area and is hurt or killed, a hot shot trial lawyer sues the truck rental company and will cash in with a 10-figure payday and bankrupt the truck rental company. After Oklahoma City, the truck companies tightened standards because of liability. People cannot rent trucks for terrorist attacks.
