Milwaukee judge accused of obstructing ICE might not see case dismissed

MILWAUKEE (CN) — A federal Wisconsin magistrate judge recommended on Monday that the court deny Milwaukee County Circuit Court Judge Hannah Dugan’s motion to dismiss the obstruction charges brought against her.

“Whether Dugan violated these statutes as the government accuses, or whether she was merely performing her judicial duties as Dugan asserts, these are questions for a jury that cannot be resolved on a motion to dismiss,” U.S. Magistrate Judge Nancy Joseph wrote in a 37-page ruling.

U.S. District Judge Lynn Adelman, a Bill Clinton appointee, will take Joseph's recommendation under advisement and issue a final decision on the motion sometime in the coming weeks.

Dugan, 66, was arrested by FBI agents in April at the county courthouse while on her way to work before being shackled and transported to the federal courthouse for an initial appearance.

She was later indicted on charges of obstruction and intentionally concealing an individual set for deportation, both felonies. The government claims she helped Eduardo Florez-Ruiz, who had been accused of living in the country illegally for 25 years, evade ICE agents waiting outside her courtroom by leading him out a private side door.

In a motion to dismiss, Dugan claimed judicial immunity, citing its long history since the inception of the U.S., and the many tests to that commitment. She said the federal government had no constitutional rights for her to take away.

The government countered in its response to Dugan's motion that Dugan’s acts were extrajudicial and that — while judges may have immunity from civil suits for monetary damages — judicial immunity does not apply in criminal cases at all.

Joseph agreed. "There is no firmly established absolute judicial immunity barring criminal prosecution of judges for judicial acts," she wrote...

The case has not been NOT dismissed. The article only states that some other judge wrote a letter to the deciding judge arguing that the case SHOULD not be dismissed.

Step one towards reeling in the judicial tyranny that lower courts are invested in. A few behind bars, stripped of their pension and future should help impart some reason on these judges.

I hope she’s punished, but it’s quite clear to see, both in Europe and the US, that giving that tribe power was NEVER a good idea when it comes to protecting our countries from migrant invasion - it’s simply how they’re wired. And it should be noted that before the 19th Amendment took full force (in the 21st century), no successful country had ever INTENTIONALLY dissolved its culture...at least no country that I can think of.

Since she is very obviously guilty, the case certainly should not be dismissed. If it is, she is "above the law".

Confronting ICE agents not in her courtroom, adjourning proceedings for no reason and then leading the illegal alien defendant through a back door closed to the public are not “judicial acts” she is entitled to make.

In Milwaukee, I seriously doubt that they will be able to get 12 jurors to vote for a guilty verdict regardless of how indisputable her guilt actually is.

In other words likely jury nullification.

You’re probably right. It’s the left’s way of fighting the CW we appear to be in. The next time a democrat president gets elected, the borders will be open again. Need some sort of legislation to allow states to evict illegals.

Clinton appointed district court judge to decide if she gets tried or not.
She will not be tried but will be forced to resign - my guess.
