Appeals court lets Trump keep control of National Guard troops deployed to Los Angeles

An appeals court on Thursday allowed President Donald Trump to keep control of National Guard troops he deployed to Los Angeles following protests over immigration raids.

The decision halts a ruling from a lower court judge who found Trump acted illegally when he activated the soldiers over opposition from California Gov. Gavin Newsom.

The deployment was the first by a president of a state National Guard without the governor’s permission since 1965.

In its decision, a three-judge panel on the 9th U.S. Circuit Court of Appeals unanimously concluded it was likely Trump lawfully exercised his authority in federalizing control of the guard.

It said that while presidents don’t have unfettered power to seize control of a state’s guard, the Trump administration had presented enough evidence to show it had a defensible rationale for doing so, citing violent acts by protesters.

That’s nice. But no court can end it. The Congress can override his emergency declaration, but the courts cannot cancel a declaration of emergency.

According to the Constitution, if this had been a crime oriented riot only, then the lower court was right. But, because it was an attack on ICE and federal properties the group was mixed with illegals thus it can be considered an insurrection.

But here’s one the feds should use:

While no single article of the US Constitution explicitly states that a citizen automatically loses their citizenship for fighting with an opponent, Article III, Section 3 defines treason and its potential consequences.

Treason, as defined in the Constitution, consists of:

Levying War: This involves assembling armed individuals to overthrow the government or resist its laws.

Adhering to Enemies, Giving them Aid and Comfort: This entails providing support to countries or groups actively at war with the United States.

Punishment for Treason:

Congress has the power to determine the punishment for treason, which can include death or imprisonment for no less than five years, along with fines.

A person convicted of treason can also be barred from holding any office under the United States.

I do not understand why the feds haven’t brought this down. It would limit the paid protestors from causing harm to people and property and the citizens being identified as insurrectionist thus treasonous so everyone in the battle is considered an enemy of the country.

We have 94 appointed federal district court kings usurping his authority as elected national executive.

"Likely"?? That's a squishy interpretation. How does that work? Something is either lawful or not. What's this middle ground "likely lawful"?

Is that the court panel saying that or the reporter?

To rule against Trump the court would be expected to explain why Presidents were able to nationalize the National Guard against the wishes of Governors Faubus and Wallace to desegregate state schools against threats of riots.

What’s nice about the decision is that Newsom cannot control the national guard if there are conditions where federal control is deemed necessary. So if Newsom decides not to pay federal taxes and uses National Guard to arrest IRS or other federal agents, the President can override the governor, and make the National Guard stand down. Newsom really has no policing powers...he won’t get local police to do his bidding...highway patrol won’t help him.
The schizophreniform governor is done. Will go down in history as Emperor Norton the Second.
