Trump hails favorable federal appeals court ruling on his sweeping tariff policy as a 'great' win

President Donald Trump on Wednesday hailed a favorable decision by a federal appeals court over his sweeping tariff policy as a “great” win for the United States.

Trump said on his social media site that the court’s decision Tuesday night to let the government keep collecting his sweeping import taxes while challenges to his signature trade policy continue on appeal means the U.S. “can use TARIFFS to protect itself against other countries.”

“A great and important win for the U.S.," Trump wrote.

The decision by the U.S. Court of Appeals for the Federal Circuit extends a similar ruling it made after another federal court struck down the tariffs May 28, saying Trump had overstepped his authority. Noting that the challenges to Trump’s tariffs raise “issues of exceptional importance,″ the appeals court said it would expedite the case and hear arguments July 31.

The case involves 10% tariffs the Republican president imposed on almost every other country in April and bigger ones he imposed and then suspended on countries with which the United States runs trade deficits. It also involves tariffs he plastered on imports from China, Canada and Mexico to pressure them to do more to stop the illegal flow of immigrants and synthetic opioids across the U.S. border.

If I understand this correctly, this is a temporary stay, which means Trump’s tariffs can continue being collected for now while the court reviews the case more fully. This does not mean the tariffs were ruled lawful yet — only that the lower court’s decision to block them is paused during the appeal.

Typically stays and injunction occur only when they believe the likely outcome will support them or the potential harm is so great that an un adjudicated restriction is necessary until it is heard in court.

I think this stay is likely because the law is clearly on Trump’s side.

You are correct sir.

And I still think he loses. The 10%, across the board tariffs is the hardest one to defend legally.

Well, I disagree. Likelihood of success on the merits is only one of the four factors regarding the issuance of an injunction, with the others going more towards the harm caused one way or the other. Overturning a presidential action that has an impact on foreign trade without significant arguments on the merits is something a federal appellate court didn't want to do, and rightfully so.

If full briefing on the merits convinces the court that the president is right, then there will have been no inconsistencies or back and forth in US policy. That's a good thing. If it turns out the plaintiffs are correct, then the only harm is a purely monetary harm for which the plaintiffs can be compensated.

The US and China came to a trade agreement this morning. I think the courts ruling made China think twice.

President Trump will win this in the end or they would not have lifted the hold.

Set an en banc hearing date of July 31st. A decision will likely be a few weeks after that.

Helps when the Chief Judge is to the right of Atilla the Hun.
