We have laws on the books dealing with illegal aliens and deportation proceedings.
If we follow those established laws and policies, that is due process for people in this country. That is following the law.

The process that is due to them is determined by the president. Congress passed that law. The SCOTUS ruled over 100 years ago that nobody has either a liberty or a property interest in being in the country ILLEGALLY AND they held that deportation is not “punishment” AND they held that there is “no role” for the judiciary. That has never been overturned or challenged and remains the law of the land.
I think the guy is saying a judge has to decide that they are illegally here first. That’s the due process, to determine if they are in fact illegally in the US. Once that is completed, they are DUE to be deported.
James Lankford (R-OK) defeated his Democrat opponent for senate in 2022. He won with 64.3% of the vote. His opponent only received 32.1% of the vote.
Lankford can count on two things:
1. He will have the overwhelming advantage of incumbency in future elections.
2. Republican voters will reelect him in the general election citing “the Lesser of Two Evils” excuse.
This is how RINOs stay in power for thirty years.

Yeah, this is pretty much all the conversation that needs to take place. And in my view, if that conversation takes place with an authorized representative of the US government, that fulfills the due process requirement.
We need to be sure that the person is here illegally, and if they cannot provide proper documentation, then that's their fault. This should not be the least bit complicated.
You have to state information and sign a 1040.
Invaders could also be required by federal law to do something similar, but with a few simple questions the USCIS thinks are applicable.
If they lie on the form, they can be imprisoned just like you could be for lying on a 1040. For how long? For as long as they have delayed things, or maybe a year more. Where? Anywhere the USCIS can place the liar.
Giving the invader a form to fill out and sign is not a lot of work.

(c) The Attorney General may, in his discretion and on the basis of reciprocity pursuant to such regulations as he may prescribe, waive the requirement of fingerprinting specified in subsections (a) and (b) in the case of any nonimmigrant.

WASHINGTON - Today, DHS Secretary Kristi Noem reminded all foreign nationals present in the United Stated longer than 30 days that the deadline to register under the Alien Registration Act is coming up on April 11.
This law requires all aliens in the United States for more than 30 days to register with the federal government. Failure to comply is a crime, punishable by fines, imprisonment, or both.
Upon registration and fingerprinting, DHS will issue proof of registration. All noncitizens 18 and older must carry this documentation at all times. This administration has directed DHS to prioritize enforcement, there will be no sanctuary for noncompliance.
