India does not have a blanket requirement mandating that foreign manufacturers must share their intellectual property (IP) to manufacture in the country.
India’s intellectual property laws, governed by statutes such as the Patents Act, 1970, Copyright Act, 1957, Trade Marks Act, 1999, and Designs Act, 2000, do not impose a universal requirement for foreign manufacturers to share their IP as a condition for manufacturing in India.
Foreign manufacturers can protect their IP in India through patents, trademarks, copyrights, and industrial designs, similar to domestic entities, without being compelled to transfer or share proprietary technology or IP unless specific contractual or regulatory conditions apply.
