U.S. businesses sue to block Trump tariffs, say trade deficits are not an emergency

A group of five small businesses sued President Donald Trump on Monday, seeking to block new tariffs he has imposed on foreign imports in recent weeks.

The lawsuit in the U.S. Court of International Trade alleges that Trump has illegally usurped Congress’ power to levy tariffs by claiming that trade deficits with other countries constitute an emergency.

The Liberty Justice Center, which is representing the owner-operated companies, said Trump’s new tariffs of at least 10% on imports from most countries and higher rates for scores of other nations are devastating small businesses across the country.

“His claimed emergency is a figment of his own imagination: trade deficits, which have persisted for decades without causing economic harm, are not an emergency,” the suit says.

“Nor do these trade deficits constitute an ‘unusual and extraordinary threat.’”

The Liberty Justice Center noted that the Trump administration imposed tariffs even on countries with which the United States does not have a trade deficit, “further undermining the administration’s justification.”

“This Court should declare the President’s unprecedented power grab illegal, enjoin the operation of the executive actions that purport to impose these tariffs under the IEEPA and reaffirm this country’s core founding principle: there shall be no taxation without representation,” the suit says.

The plaintiffs include New York-based VOS Selections, which imports and distributes small-production wines, spirits, and sakes; FishUSA in Pennsylvania, a retail and wholesale e-commerce business making and selling sportfishing tackle and related gear; and Genova Pipe in Utah, which makes plastic pipe, conduit, and fittings for plumbing, irrigation, drainage, and electrical applications.

MicroKits LLC in Virginia, which makes educational electronic kits and musical instruments, and Terry Precision Cycling, a Vermont-based brand of women’s cycling apparel, are also plaintiffs.

These are probably legit businesses that rely on imports, but my cynical *** would check to see what kind of foreign ties they may have hiding in the books.

They don’t have any “standing”. Take a hike bozos. Any time our taxpayer dollars are being part of this country’s fraud, waste and abuse program, IT’S AN EMERGENCY.

Gaping oozing bloody mess of a financial situation for the US and businesses say not an emergency. It they saw it as a human wound maybe they would understand. We been bleeding out for decades and only alive due to pretend blood being pumped in as the gaping wounds continue to bleed it out. Nope no emergency.

President Trump is taking bold action to hold Mexico, Canada, and China accountable to their promises of halting illegal immigration and stopping poisonous fentanyl and other drugs from flowing into our country.

The orders make clear that the flow of contraband drugs like fentanyl to the United States, through illicit distribution networks, has created a national emergency, including a public health crisis.

Chinese officials have failed to take the actions necessary to stem the flow of precursor chemicals to known criminal cartels and shut down money laundering by transnational criminal organizations.

In addition, the Mexican drug trafficking organizations have an intolerable alliance with the government of Mexico. The government of Mexico has afforded safe havens for the cartels to engage in the manufacturing and transportation of dangerous narcotics, which collectively have led to the overdose deaths of hundreds of thousands of American victims. This alliance endangers the national security of the United States, and we must eradicate the influence of these dangerous cartels.

There is also a growing presence of Mexican cartels operating fentanyl and nitazene synthesis labs in Canada. A recent study recognized Canada’s heightened domestic production of fentanyl, and its growing footprint within international narcotics distribution.

illegally usurped Congress’ power to levy tariffs

If I understand things correctly, this is one of those items that Congress has surrendered to Executive authority through legislation.

Most of Congress would rather spend their time trying to figure out how to enrich themselves at taxpayer expense so they are happy to delegate as much as possible - hence the bureaucratic "4th branch" of government.

Haven’t decorated a Christmas tree in years?

Bring your decorations here on consignment!

Businesses can get billions in Chinese-made goods without having to pay Trump tariffs.

Don’t fret, change your business model.

THIS QUOTE FROM THE ARTICLE:
"...“His claimed emergency is a figment of his own imagination: trade deficits, which have persisted for decades without causing economic harm, are not an emergency,” the suit says. “Nor do these trade deficits constitute an ‘unusual and extraordinary threat.’”

Astonishing. The statement "persisted for decades without causing economic harm" almost made me fall out of my chair.

I see people everywhere, even on this very forum who want to continue onward using the playbook that has been used for the last 80 years, and which has led us to being $37 Trillion in Debt, with the debt increasing by $1 Trillion every 90 days, and $600 Billion being spent annually just to service the interest on our debt.

People are upset that their investments are being affected. I am too.

But the future of this country I love is bigger than any individual, even if we as conservatives value individuality, which these "small business owners" clearly do not.

What is so hard to understand about the fact that we are broke, we are$37 Trillion in Debt, with the debt increasing by $1 Trillion every 90 days, and $600 Billion being spent annually just to service the interest on our debt, and that this situation is not sustainable?

All those precious, hard earned dollars in our investments are going to evaporate if we do not bring industry back into our country, established fair trade, and address our enormous government bloat which not only hamstrings our economy with the salaries of unneeded workers who have long supported government as a jobs program, the regulations imposed by such a large parasitic entity are choking our ability to maintain an industrial base.

And saying that if we don't address that will result in ALL of our investments going belly up (and, our nation, and us with it) is not hyperbole.

I challenge anyone to argue that being$37 Trillion in Debt, with the debt increasing by $1 Trillion every 90 days, and $600 Billion being spent annually just to service the interest on our debt will NOT destroy this nation, our savings, and us with it.

These people suing should be asked: Do you want to preserve your current savings at the cost of losing this nation where you will lose those savings anyway, or are you going to support our current Administration and its efforts to begin to slow our headlong rush towards national oblivion?

Anyone who thinks saving this nation is going to be easy and painless does not understand the hole we are in, and how time and compound interest are conspiring to bear down on us to put an end to this nation we love.

To state this baldly is not hyperbole or hysteria. We need to make a stand, and we have run out of time.

These selfish, Leftist a-hole "small business owners" (and yeah, regardless of how these "small business owners" classify themselves they are Leftists or assistant Democrats) are exactly the ones who are so incredibly, densely stupid, they cannot understand that everything they have will vanish if we plummet off that cliff of insolvency. They no doubt are the same ignorant dumb-asses, based on the quote from their "lawyer" who believe we can just print more money.

Who is surprised that they could find 5 - merely FIVE - businesses who might be upset that their business model which relies upon the old status quo has been upended, a business model which wholly supports unfavorable trade agreements negotiated in bad faith by prior actors NOT in the interest of US workers?

Whether trade deficits are an emergency is debatable, the fentanyl problem and its 100,000 deaths annually is an emergency without the slightest doubt.

A group of five small businesses sued President Donald Trump
———————-

Five small businesses? Five small businesses trying to play the Democrat law fare card. Why is it Democratics always run to crooked judges when they don’t agree with Trump’s policies?

They will fail, and hopefully piss away their holdings paying huge legal fees. They never learn.

Make them pay President Trump’s attorney fees when they lose.
